• 中文摘要： 反傾銷制度自民國七十二年引進我國之後，截至目前共有三十二件申請案，其中六件課徵反傾銷稅，七件以價格及數量具結結案，其成立之比率達40.6％，若再扣除因為格式不合及申請人撒回之七件，其比率更高達52.0％。依據本文研究顯示，反傾銷制度無論在經濟效果及經濟理論上均是弊大於利，故有待大力改進。另一方面傾銷行為亦有可能違反公平法第十條第一項第二款、第十九條第三款及第二十四條。傾銷行為若果真同時違反貿易法與公平法，本文認為因為該二法之法律效果截然不同，故均有適用之餘地，二法之主管機關均享有管轄權。再者，濫用反傾銷亦有可能違反公平法。本文在最後指出反傾銷制度與公平法間可相互借鏡之處，供二者未來改進之參考。
• 英文摘要： Since the introduction of anti-dumping regime in 1983, it has been altogether 32 applications filed todate. 6 of which led to the imposition of anti-dumping duties, 7 of which ended up with undertakings. A successrate of ca. 40.6%，which rises even to 52.0% when taken the applications out of consideration, that were eitherimproperly filed and rejected or withdrawn by the applicants. The study of this paper shows the drawbacks ofanti-dumping outweigh its benefits. On the other hand, dumping can at the same time violate the Fair TradeLaw, namely Art. 10, Para. 1，Subpara. 2; Art. 19 Subpara. 3 and Art. 24. Dumping, which eventually violatesthe Foreign Trade Law and the Fair Trade Law simultaneously, falls within the jurisdiction of the two Laws.But no dopple punishment is to be worried about, since the two Laws have totally different legal consequence.Furthermore, misuse of the anti-dumping mechanism by enterprises could constitute a violation of the FairTrade Law as well. At the end, this paper points out how the anti-dumping system can be improved in light ofthe Fair Trade Law and vice versa.
